1. Use of TheGrocery Website

Thegrocery is provided free of charge for personal use, subject to these Terms and Conditions. By using thegrocery.uk, you agree to be bound by these Terms and Conditions.

We reserve the right to change the content at any time. While we try to keep information up-to-date, we do not guarantee that the content is free from errors or omissions.

2. Becoming a Customer
2.1 Registering on TheGrocery Website
To place an order, you may login with your Shop account or register. To register, you must:

- Provide your real name, address, phone number, email address, and any other details requested
- Provide a delivery address within the UK
- Have a credit or debit card acceptable to us in your name
2.2 Your Username and Password
Keep your username and password confidential, as you will be responsible for all activities and orders made using these details. Contact us immediately if you think someone else may know or use your username and password.
2.3 Right to Decline Registration or Order
We reserve the right to decline a new customer registration or order, or to suspend or disable your account at any time at our discretion.
3. Your Contract with Us
3.1 Order Acknowledgement
Once you place an order, we will send you an order acknowledgment by email. This is only an acknowledgment, not an acceptance of your order.
3.2 Formation of Contract
A legally binding contract will only be formed when we email you to confirm that the items you ordered have been dispatched. The contract will be formed in, and subject to, the laws of England.
3.4 Availability
If an item is out of stock, it will be labeled as such on our website. If we are unable to supply an item for any other reason, we will not be liable except to ensure you are not charged for that item. We may place restrictions on the number of units of a particular item you can order and reserve the right to withdraw any item from sale.
4. Price and Payment
4.1 Pricing Errors
We reserve the right to change prices at any time without notice. If a pricing error is found within 7 days of your order for items not yet dispatched, we will notify you and offer options to place a new order at the correct price, cancel the mis-priced item(s), or cancel the entire order.
4.2 VAT
All prices include VAT. The total price you pay includes delivery and any other services.
4.3 Method of Payment
You must pay in pound sterling using a UK-based credit or debit card or PayPal. If an exchange rate is applicable, your card provider will determine the rate and may add an administration charge.
4.4 Debit of Payment
Payment will be debited from your account upon order submission. This does not form the contract (see 'Your Contract with Us').
5. Delivery
5.1 Delivery Charges
You can choose delivery to your home or another UK location. Delivery charges are detailed on our 'Delivery Information Page'.
5.2 Large Item Charge
The delivery charge is based on your total order. If your order includes a large item, the delivery charge will be higher.
5.3 Delivery Time Estimates
Delivery times are estimates. If you live in a remote UK location or order large items, delivery may take longer.
5.4 Items Requiring Signature
A signature may be required at delivery. By placing an order, you authorize us to accept a signature from another person at the same address if you are not present.
5.5 Instructions for Alternative Delivery Location
For items not requiring a signature, you may provide instructions for an alternative delivery location, such as with a neighbor. We are not responsible for missing parcels left in an alternative location.
5.6 Large Items
Ensure you check access to your premises before ordering large items. Do not book additional services until your items have arrived.
6. Cancelling Your Order
6.1 Cancelling an Order Prior to Delivery
To cancel an order prior to delivery, contact Customer Services by email or phone. If the item(s) have not been dispatched, the full price will be refunded. If dispatched, do not refuse delivery. Refunds will be processed once the parcel is returned within 15 days, with delivery costs deducted.
7. Returns After Delivery
7.1 Changing Your Mind
You can cancel your order within 15 calendar days after delivery for an exchange or refund. See "Return & Refund Policy".
7.2 Excluded Items
Certain items cannot be returned unless faulty or mis-described. See "Return & Refund Policy".
7.3 Costs for Returning Items
You are responsible for the cost of returning non-faulty items. See "Return & Refund Policy".
7.4 Faulty/Damaged Items
If an item is faulty, mis-described, or parts are missing within 3 days of delivery, return it for a refund, replacement, or repair. After 3 days, we are not responsible, and the item may not be returned.

8. Refunds
8.1 Methods of Refunds
Refunds will be processed in the same way you paid.
8.2 Processing Time
Refunds will be processed within 15 calendar days of receiving the item(s). It may take an additional 1-2 working days to appear in your account.
8.3 Costs for Returning Items
We are not responsible for the costs of returning items unless they are faulty or as otherwise permitted by these terms.
9. General Provisions
9.1 Entire Agreement
These Terms and Conditions regulate the supply of goods. Any other terms, conditions, or representations (other than those made fraudulently or implied by statute) are excluded.
9.2 Non-Waiver of Future Right to Enforce
Failure to take action in respect of a breach does not waive our right to enforce these Terms and Conditions subsequently.
9.3 Severability
If any part of these Terms and Conditions is unenforceable, the enforceability of the remaining provisions will not be affected.
9.4 Force Majeure
We are not liable for delays or failure to comply with these Terms and Conditions due to events beyond our control.
